TERMS OF PARTICIPATION IN THE FMEA CENTER INTERNET FORUM („Terms and Conditions”)
- These Terms and Conditions specify the terms of participating in the discussion forum (hereinafter referred to as „Forum”) available on CENTRUMFMEA.pl (hereinafter called „Platform”) posted in fmea.com.pl domain on: https://fmea.com.pl/regulamin-forum/.
- The forum is a service rendered by electronic means by PROQUAL Management Institute – B. T.Greber Spółka Jawna with its registered office in Wrocław, at ul. Ostrowskiego 30, 53-238 Wrocław, Poland, registered in the District Court for Wrocław-Fabryczna in Wrocław, VI Commercial Division of the National Court Register under KRS no. 0000293286, REGON [business ID no.]: 020643389, NIP [taxpayer’s ID no.]: 8971735808 (hereinafter referred to as „PROQUAL”).
- The forum is made available to users who can post their reviews and remarks on specific subjects as well as see and comment on reviews of other users. Each user of the Forum is obligated to follow these Terms and Conditions as well as rules of etiquette.
- All Internet users who visit the Platform are allowed to access the Forum, read reviews and remarks (hereinafter called „Entries”) and post their own entries.
- Every user who visits the Platform is allowed to sign up on the Forum. The registered user is entitled to create one account, as well as log in to publish its Entries.
- To sign up on the Forum, it is necessary to fill in the electronic form available on the Platform. To sign up, it is necessary to enter e-mail address serving as a login, username (the so-called nickname), password and then accept the Terms and Conditions. After sending a complete electronic form, the user receives an e-mail message with a request to confirm the registration. Every Forum user may create one account only.
- PROQUAL shall not be held responsible for consequences arising from disclosure of the password intended for Forum registration, irrespective of the circumstances and causes of such disclosure.
- Users are free to choose any username (nickname) provided it does not violate the rules of law and other people’s rights or principles of community life and good practices. The name entered during registration shall be the user’s ID on the Forum, and shall serve to mark its Entries and allow logging when entering the Forum. The username must not contain non-standards characters and more than 15 characters.
- Every Forum user is obligated to follow the rules of law, the Terms and Conditions as well as principles of etiquette. The entries posted by Forum users must not contain the following:
- illegal contents, e.g. threatening, insulting, harming reputation, violating privacy or other personal rights of other persons, violating copyrights and other law-protected rights;
- contents at variance with principles of community life and good practices, and in particular: vulgar, obscene, hateful, aggressive, discriminating and other of this sort;
- contents which propagate illegal actions;
- advertisements which contain SPAM, „Chain letters” messages;
- links redirecting to websites with the aforesaid content, and in particular specified in a)-c);
- contents and behaviors which infringe principles of etiquette.
- Every Forum user posts Entries on the Forum solely on its own responsibility. PROQUAL shall not be held responsible for the content of the Entries posted by users on the Forum.
- PROQUAL reserves a right to delete Entries which violate the Terms and Conditions, and in particular its 9th point, and to delete accounts, without warning, of users who grossly and systematically violate the Terms and Conditions, and in particular its 9th point.
- Forum users may report entries subject to deletion through „report violation” option available by every Entry.
- A part of the PC IP address used to send the Entry may be visible by the user’s Entry. Forum users data collected by PROQUAL may be disclosed to authorized state authorities at their request for the purposes of their proceedings. PROQUAL shall do its utmost to protect Forum users’ data, yet it is not responsible for hacker attacks aimed at obtaining users’ data.
- By posting Entries on the Forum, the Forum user gives its consent to disclosing these Entries along with the user name (nickname) in all platforms and publications made by PROQUAL and its databases.
- PROQUAL will do its best to make sure the Forum works well and provide assistance in solving functioning problems. PROQUAL reserves a right to shut the Platform down temporarily due to maintenance breaks as well as adopt new functional solutions, including the ones which raise safety and quality of Forum operation.
- Potential complaints related to Forum operations shall be sent to the e-mail address entered in the Contact section and shall specify the following data: complainant’s data – first and last name or business name (for entities), place of residence/head office, e-mail address; the complaint subject. The complaints shall be considered by PROQUAL within 30 working days after complaint receipt (incl. data referred to in the preceding sentence).
- Any questions or reservations concerning the Forum operation shall be reported to the administrator and e-mail address entered in the Contact section.
- PROQUAL is entitled to close the Forum as well as close, delete or archive specified entries and threads on the Forum at any time, and is not obligated to give reasons for this.
- The Terms and Conditions shall become effective upon publication on the Platform, that is from 25.06.2018.
- PROQUAL reserves a right to modify the Terms and Conditions at its convenience. The modifications shall become effective upon their publication in the Terms and Conditions.
- The administrator of personal data (hereinafter referred to as the Administrator) is PROQUAL Management Institute – B. T. Greber Spółka Jawna with its registered office in Wrocław, ul. Ostrowskiego 30, 53-238 Wrocław
- Providing data in the form of an e-mail address and username is required for registration to the Forum.
- The administrator applies appropriate organizational measures, procedures and standards to ensure the security of personal data processing, meeting the requirements of the GDPR.
- The person whose data is processed and stored has the right to demand from the Administrator:
- access to their data and the publication of copies of this data;
- rectification (correction) of data;
- data deletion;
- restrictions on data processing;
- transfer of data to another administrator;
- object to the processing of data.
- In certain cases, we may transfer the data of persons purchasing tickets to authorized bodies, i.e. the Police, the Court, the Prosecutor’s Office.
- In addition, we may only transfer User’s data to two groups of recipients:
- If the person whose data is processed finds that their processing by the Administrator violates the law, then he has the right to lodge complaints to the President of the Office of Personal Data Protection.
- Does not transmit data outside the European Economic Area.
- The data of participants will be processed during the period of being registered in the forum and stored for a period of 3 years after the period of account deletion.
- Personal data is not processed in an automated manner.
